Dr. Julien Musolino was invited by the New Jersey State Bar Association to deliver a keynote address during ADR Day 2025 at the New Jersey Law Center in New Brunswick.
In today’s legal landscape, where the vast majority of civil cases resolve before trial, pre-trial decision-making plays a central role in case outcomes. In this invited program, Dr. Musolino introduced a research-driven framework for analyzing pre-trial strategy, drawing on behavioral economics, cognitive psychology, data science, and decision science.
The presentation examined how cognitive biases, risk perception, and probabilistic reasoning shape negotiation, mediation, and settlement dynamics, with particular attention to the ADR phase of litigation. By integrating insights from cognitive science with legal practice, the program explored how more systematic and quantitative approaches can complement professional judgment in high-stakes decision-making.
